Terms and Conditions of Sale and Usage of Newton-Rider Products

Welcome to the Newton-Rider online store. These Terms and Conditions govern your purchase and use of Newton-Rider products and services. By accessing our website or purchasing our products, you agree to these Terms, as well as our Privacy Policy and any additional terms we may provide.

If you do not agree to these Terms, you may not purchase Newton-Rider products or use our services.


1. Orders and Pre-Orders

1.1 Order Processing
Orders are charged upon placement and are typically shipped within 3-5 business days. Pre-orders and out-of-stock items may have longer shipping times.

1.2 Refunds for Delayed Pre-Orders
If Newton-Rider cannot ship your pre-ordered product within four (4) months of your order, you are entitled to a full refund. Refunds will be processed automatically unless you request otherwise.

1.3 Taxes and Duties
Prices displayed do not include taxes, duties, or other governmental charges unless specified. These charges are your responsibility and may vary by country.

1.4 Restrictions on Resale
Products sold through our online store are for personal use only and not for resale. Businesses interested in bulk purchases should contact us directly at contact@newton-rider.com.

2. Right of Withdrawal (EU Customers)

2.1 14-Day Cooling-Off Period
As an EU customer, you have the right to cancel your order within 14 days of receiving the product without giving any reason. To exercise this right, contact us at contact@newton-rider.com.

2.2 Refund Process
We will refund the full purchase price, including original shipping costs, within 14 days of receiving the returned item or proof of its return. The product must be unused, in its original condition, and include all packaging and tags.

2.3 Return Shipping
You are responsible for the cost of return shipping. We recommend using a trackable shipping method to ensure safe delivery.

3. Payments

3.1 Payment Authorisation
By providing payment details, you confirm authorisation to use the payment method and agree to charges for the total amount, including taxes and fees.

3.2 Failed Payments
Orders may be delayed, suspended, or canceled if payment fails. You are responsible for resolving payment issues promptly.

3.3 Changes to Payment Details

4. Pricing, Promotions, and Availability

4.1 Price Changes
Prices are subject to change without notice but will not affect confirmed orders.

4.2 Promotions and Discounts
Promotional codes and discounts are valid for six months unless otherwise stated. They cannot be combined, exchanged for cash, or applied retroactively. Newton-Rider reserves the right to modify or end promotions at any time.

4.3 Errors in Pricing or Availability
We reserve the right to cancel orders due to errors in pricing or availability, even after order confirmation.

5. Shipping and Delivery

5.1 Shipping Costs
Shipping costs are calculated at checkout and vary by destination.

5.2 Risk of Loss
Responsibility for products transfers to the purchaser upon delivery to the carrier. Newton-Rider is responsible for loss or damage during transit.

5.3 Delivery Timeframes
Delivery times are estimates and not guaranteed. Delays may occur due to external factors beyond our control.

6. Limited Warranty

6.1 Statutory Warranty (EU Customers)

Under EU law, consumers are entitled to a two-year legal warranty starting from the date of delivery. This statutory warranty ensures that products are in conformity with the purchase contract. If a product is found to have a defect that existed at the time of delivery, you may request a repair, replacement, or refund. This statutory warranty is provided separately from, and in addition to, the Newton-Rider Limited Warranty.

6.2 Newton-Rider Limited Warranty

In addition to the EU statutory warranty, Newton-Rider warrants all products sold by Newton-Rider to be free of defects in materials and workmanship for one (1) year from the date of purchase unless otherwise specified. If a product is found to be defective by Newton-Rider, in its sole discretion, Newton-Rider’s only obligation will be to repair or replace the defective product.

Newton-Rider disclaims all liability for costs, losses, damages, or injuries incurred due to the loss or use of its products, and specifically disclaims all claims for consequential and incidental damages.

6.3 Restrictions and Exclusions

The following restrictions and exclusions apply to the Newton-Rider Limited Warranty:

6.3.1 Applicability

This warranty only applies to products purchased directly from Newton-Rider or from an authorised partner.

It is valid only for the original purchaser and cannot be transferred upon sale, transfer, or lease of the product.

Any replacement product can only be provided within the country of purchase.

6.3.2 Exclusions

Normal wear and tear.

Damage caused by misuse, malicious acts, accidents, negligence, natural calamities, physical force, or misapplication of electricity.

Damage resulting from unauthorized repairs, modifications, or the combination of the product with third-party items (e.g., cameras, sealants, custom pads, wings, or rocket engines).

Damage caused by external factors such as extreme weather, improper storage, or physical impact.

6.3.3 Void Warranty

The warranty will be void if:

Any repair or modification is performed by anyone other than Newton-Rider or its authorised agents.

The product is used contrary to its intended purpose or design.

6.4 Warranty Claims

To claim warranty service under either the EU statutory warranty or the Newton-Rider Limited Warranty, follow these steps:

Evaluation: Newton-Rider will evaluate your claim and determine the appropriate remedy:

Within 30 Days of Delivery: Newton-Rider will provide a replacement and cover return shipping costs.

Beyond 30 Days and Within Warranty Period: Newton-Rider will repair or replace the defective product. The customer is responsible for shipping the product to Newton-Rider, while Newton-Rider will cover return shipping costs for the repaired or replaced product.

For products purchased from Newton-Rider’s authorised partners, the provided information must match the receipt details. In case of inconsistencies, the receipt information will take precedence.

6.5 Customer Responsibility and Risk

Use of Newton-Rider products is at your own discretion and risk. Newton-Rider disclaims liability for:

Any personal injury, loss of life, or damage to property arising from the use of its products.

Loss of or damage to hardware, computers, mobile devices, or other equipment used in conjunction with Newton-Rider products.

Newton-Rider does not promise or guarantee any specific level of performance or safety associated with the use of its products.

6.6 Disclaimer of Implied Warranties

All warranties implied by any state or national law, including implied warranties of merchantability and fitness for a particular purpose, are hereby limited to the duration of the Newton-Rider Limited Warranty.

Certain jurisdictions, including some U.S. states, do not allow limitations on the duration of implied warranties. In such jurisdictions, these limitations may not apply to you.

6.7 Exclusive Remedy

With the exception of any warranties implied by law as limited above, this Limited Warranty is exclusive and in lieu of all other warranties, guarantees, agreements, and similar obligations of the seller or manufacturer.

7. Data Protection and GDPR Compliance

Newton-Rider processes personal data in accordance with GDPR and our Privacy Policy. Data may be shared with trusted partners for order fulfilment and delivery.

8. Limitations

8.1 Exclusion of Certain Damages
To the maximum extent permitted by applicable law, Newton-Rider will not be liable for indirect, exemplary, consequential, or incidental damages.

8.2 Liability Cap
Our total liability is limited to the amount you paid for the product in the six (6) months preceding the claim.

8.3 Exceptions Under Applicable Law
Some jurisdictions do not allow the exclusion or limitation of certain damages, and these limitations may not apply to you.

9. Dispute Resolution and Governing Law

9.1 Arbitration
Disputes will be resolved through confidential arbitration in Copenhagen, Denmark, under Danish Arbitration Association rules.

9.2 EU Consumer Rights

9.3 Governing Law
These terms are governed by Danish law, with consideration for applicable consumer protection laws in your country of residence.

You may return or exchange products within 30 days of receipt if they are unused, in their original condition, and include all tags and packaging.

16.3 Refund Process
Once your returned item is received and inspected, we will process your refund, store credit, or exchange as requested. Refunds will be issued to your original payment method within 14 days of receiving the item.

16.4 Damaged Returns
Newton-Rider reserves the right to reject returns if the product is not in its original condition or is damaged during return transit. Return shipping costs are your responsibility.
